The plaintiff and appellant acquired title to certain land by sheriff’s deed on April 25, 1925. Through the foreclosure of a mortgage owned by the plaintiff the property had been sold at fore-' closure sale and bid in by him on April 21, 1924. In the fall of 1924 the defendant, with knowledge of the foreclosure but expecting that the mortgagor would redeem, entered into an oral lease with the mortgagor and redemptioner for plowing and cropping the land.
