MEMORANDUM & ORDER

HURLEY, Senior District Judge.

Plaintiffs, on behalf of themselves and others similarly situated, bring this diversity action1 alleging breach of contract and violations of New York’s General Business Law (“GBL”) § 349. (Complaint (“Compl.”) ¶¶ 33^40.) Defendant moves to dismiss the complaint pursuant to Federal Rule of Civil Procedure 12(b)(6). For the reasons set forth below, the motion is granted.
