OPINION

RIORDAN, Justice.

The Public Service Company of New Mexico (PNM) filed a condemnation action to condemn property, adjacent to the property owned by Peter Pineda, Dana Pineda, Mark Ish and Nancy Fischer (Appellants), for a high voltage overhead electrical transmission line. Appellants filed a Complaint in Intervention seeking damages for inverse condemnation. The district court granted a motion to dismiss the Complaint in Intervention for failure to state a claim upon which relief may be granted.
