Irwin Rogers Insurance Agency, Inc., filed an action to enforce a promissory note signed by Ronald and Lisa Murphy. The Murphys challenged the validity of the note and additionally filed counterclaims alleging fraud, breach of contract, breach of the covenant of good faith, and asserting violations of the consumer protection act, the consumer credit codes and the usury laws.
