The issue presented on appeal is whether the lower court complied with the notice and hearing requirements of Fed.R.Civ.P. 56 when it granted summary judgment for the Defendant. On May 8, 1985, appellant Geear filed suit against Boulder Community Hospital alleging that its termination of her employment violated the Age Discrimination in Employment Act of 1967, 29 U.S. C. § 621.
