HENDERSON, Circuit Judge:
The appellant, Van Howell, filed suit in the United States District Court for the Northern District of Georgia pursuant to provisions of 42 U.S.C. §§ 1983 and 1985(3) 1 alleging that he was maliciously arrested and prosecuted as well as physically accosted in violation of his constitutional rights.
