This case was instituted by the Department of Roads and Irrigation of the State of Nebraska, appellant, to acquire by condemnation through the power of eminent domain for state highway purposes a part of the land in Dixon County owned by Jesse B. Kennedy and Ethel Kennedy, appellees-.

Appraisers were appointed and an award made by the appraisers in the manner provided by law on the 7th day of April, 1947, for the appellees in the sum of $6,067.60. An appeal was taken to the district court and the trial there resulted in a verdict for appellees for $385 as the value of 3.434 acres actually…
