MEMORANDUM OPINION AND ORDER

NOTTINGHAM, District Judge,

This declaratory-judgment action requires the court to decide whether the federal Employee Retirement Income Security Act of 1974 preempts certain provisions of the Workers’ Compensation Act of Colorado.
