BAILEY, J.-

Action for damages to plaintiff’s residence property located in the City of Cape Girardeau as a result of being flooded by surface water. The condition of defendant’s street and storm, sewer in front of plaintiff’s property, whereby surface water is permitted to collect and flood plaintiff’s said property- in times of rain storms, has given rise to an unusual amount of litigation and the end is not yet in sight.
