I. Facts and Procedure

{¶ 1} Plaintiff-appellant and cross-appellee, Mark Greene, filed a complaint against defendant-appellee and cross-appellant, Robert Whiteside, alleging fraudulent misrepresentation and seeking an accounting. Whiteside filed a motion for summary judgment in which he argued that the trial court lacked personal jurisdiction over him. Although a magistrate had originally determined that the trial court lacked personal jurisdiction, the court ultimately overruled Whiteside’s motion.
