This is an action brought in the name of the state on the relation of the county attorney of Shawnee county to enjoin the North Topeka drainage district and its directors and a contractor from deepening and widening the Phillips ditch and from paying for the same out of the general funds of the district. The trial court made findings of fact and conclusions of law and rendered judgment against the plaintiff, refusing to enjoin the defendants from making the improvements and paying the expense thereof out of the general fund, and the…
