Kay v. Pick
District of Columbia Court of Appeals
1Opinion of the Court
WINFIELD, Associate Judge:
This is a third-party subpoena enforcement (discovery protection) case in which the trial judge granted a motion to quash a subpoena that had been served upon a former employee of the Federal Communications Commission (the “F.C.C.”). We conclude that the trial judge did not abuse her discretion in finding that the subject matter of both the documents and the testimony sought by the subpoena is protected by the law enforcement privilege. We affirm. 1
