This is a civil rights case in which plaintiffs have sued to recover damages for the death of their husband and father, Paul Frankenhauser, who was shot and killed by police in a dyeworks in the Kensington section of Philadelphia on *340the afternoon of September 1, 1970.1 Named as defendants are the police officers who allegedly fired the fatal shots and their superiors in command.
