The Wm. R. Moore Dry Goods Company sued Anderson upon the balance of two promissory notes executed by Anderson to the .appellee, who was plaintiff below. The case was tried upon an agreed statement of facts, as follows:
“It is agreed by and between Maynard, FitzGerald & Venable attorneys for William R. Moore Dry Goods Company, and Brewer & Brewer, attorneys for defendant C. M.
