Joseph Franczyk, on trial in the recorder’s court, of Detroit without a jury, was charged and convicted of larceny from a store under section. 360 of the Michigan penal code (Act No. 328, § 360, Pub. Acts 1931 [Comp. Laws Supp. 1940, § 17115-360, Stat.' Ann. § 28.592] ). Sentence was imposed and he has appealed.
