Defendant, Michael Stewart, was found guilty of breaking and entering a business place with intent to commit larceny (CL 1948 § 750-.110 [Stat Ann 1962 Rev § 28.305]) after a jury trial in the Recorder’s Court of Detroit. Defendant’s motion for judgment of acquittal notwithstanding the verdict was denied. He was sentenced to a term of 3-1/2 to 10 years.
