In this action to foreclose a statutory hen, the defendant Frederick L. Anderson, appeals from the summary judgment rendered by the trial court in favor of the plaintiff, Congress Street Condominium Association, Inc., as to liability only, based on the nonpayment of common charges and fines.1 On appeal, the defendant claims that the court improperly granted the plaintiffs motion for summary judgment regarding the imposition of fines.2 The defendant claims, as well, that his special *538defense of equitable estoppel was properly before the court and created a genuine issue of…
