The Vermont Union School District No. 21 (school district) instituted this action on July 26, 1976, against its general contractor, the H. P. Cummings Construction Company (Cummings), and Cummings’ roofing subcontractor, Major L. Rodd, Inc. (Rodd), for alleged defects in the school district’s Blue Mountain School roof. Its complaint alleged that the new roof had widespread leakage problems caused by the roof’s blistering and bubbling surface.
