Beversing.

On October 19, 1908, plaintiff, Prank Inman, entered into a written contract witb tbe defendant, Stearns Lumber Company, by tbe terms of wbicb plaintiff was to baúl and log .about a million feet of timber to tbe Kentucky & Tennessee Bailroad side track for tbe defendant. He was to be paid different prices, according to tbe length and size of tbe timber, tbe prices ranging from $5.25 to $7.50 per one thousand feet.
