GODFREY, Justice.

Charged with operating under the influence of intoxicating liquor under 29 M.R. S.A. § 1312-B (Supp.1981), 1 defendant-ap-pellee Roger LeGassey moved for the suppression of evidence. From an order of the District Court in Millinocket granting the motion to suppress, the state appeals pursuant to 15 M.R.S.A. § 2115-A (1980 & Supp. 1982). We affirm the judgment ordering suppression.
