This matter is before the Court pursuant to Petitioner’s petition for writ of habeas corpus, the Respondent’s motion to dismiss and the Intervenor United States’ motion to dismiss.

In October, 1979, Petitioner was convicted by a jury in the Circuit Court of Prince George’s County, Maryland, of kidnapping *129and was sentenced on November 29, 1979, to 25 years incarceration.
