MEMORANDUM AND ORDER

THEIS, District Judge.

This matter is before the court on cross motions for summary judgment. Defendant Department of Energy (DOE) has moved for summary judgment on its counterclaim against plaintiff Conoco, Inc. DOE requests that the court enter an order requiring Cono-co to deposit into the escrow account established by the court the sum of $8,635,074 plus additional prejudgment interest accruing after September 30, 1993. Doc. 2150 (DOE’s amended cross motion for summary judgment). Conoco opposes DOE’s motion and seeks summary judgment in its favor on DOE’s counterclaim.…
