This case involves a complaint of employment discrimination filed by Mark *738Gray with the Secretary of Labor (“Secretary”) pursuant to the Federal Mine Safety and Health Act of 1977 (the “Mine Act” or “Act”), as amended, 80 U.S.C. §§ 801-965. Following a determination that Gray’s complaint was not “frivolously brought,” Gray was granted temporary reinstatement. 30 U.S.C. § 815(c)(2).
