Department of Corrections (Employer) petitions for review of an order of the Worker’s Compensation Appeal Board (Board) which affirmed the order of a Workers’ Compensation Judge (WCJ) granting Burley Clark’s (Claimant) peti tion for penalties, pursuant to a provision of the Pennsylvania Workers’ Compensation Act (Act). 1
