This is an action for declaratory and injunctive relief, brought by the Leslie Salt Co., an owner of certain property along the San Mateo, Santa Clara and Alameda County shorelines of San Francisco Bay, against the Secretary of the Army; the Chief of Engineers, United States Army Corps of Engineers ; and the District Engineer of the Corps, San Francisco District, South Pacific Region (hereinafter the Corps) for a declaratory judgment that the Corps’ assertion of jurisdiction shoreward beyond the mean high water, (MHW) line is unlawful and…
