This is an appeal from the Circuit Court for Calvert County, in equity. The contest is between two creditors of C. A. M. Wells, and concerns the 'distribution of certain funds in the hands of T. Van Clagett, assignee of a mortgage for the purpose of foreclosure. The mortgage in question was executed March 4th, 1933, by Wells and wife to the Maryland Real Estate Title Company, to secure a series of notes totaling $20,000, bearing interest at the rate of six per cent.
