OPINION
GREER, District Judge.
The plaintiffs-appellants, five individuals and two organizations, appeal the district court’s grant of a motion to dismiss their claims for prospective, injunctive relief , for lack of subject matter jurisdiction. We REVERSE and REMAND.

The individual plaintiffs are a part of a group of individuals who allege that they were illegally stopped, searched, and/or detained by officers of the United States Border Patrol for the Sandusky Bay Station in Ohio, based upon their Hispanic appearance, race and ethnicity.
