The plaintiffs in this action sought to recover damages for breach of warranty on a contract of sale of a tractor and dozer. Plaintiffs recovered a verdict and judgment for $5,835. After its motion for a néw trial was overruled, defendant appealed.

The petition is based on a written contract or order of purchase dated at Chilli-cothe, Missouri, on December 12, 1952, whereby, it is alleged, the defendant agreed in writing to sell, and the plaintiffs agreed to buy, one Allis-Chalmers Tractor with Gar Wood Dozer, and wherein the defendant agreed that the machines would have a…
