This is a suit for damages for the breach of an alleged warranty in the sale by the defendant to plaintiff of certain blue grass seed. There was a verdict and judgment in favor of plaintiff in the sum of $870; Defendant has appealed.

The contract of sale was in writing and made by the exchange of telegrams, letters and confirmations of sale passing between the parties. ' Plaintiff is a corporation with its principal offices in Baltimore, Maryland, and is engaged, among other things, in the selling of field seeds, wholesale only.
