The plaintiff, Mark Cuban, brings this action against the defendant, the Securities and Exchange Commission (the “SEC”), pursuant to the Freedom of Information Act, 5 U.S.C. § 552 (2006) (“FOIA”) and the Privacy Act, 5 U.S.C. § 552a (2006), challenging the adequacy of the defendant’s searches for responsive records and seeking to compel the release of several records the defendant has completely withheld from disclosure.
