In this proceeding relator seeks a writ of mandamus to compel the respondent, a judge of the Wayne circuit court, to grant a petition, heretofore presented to and denied by him, for an order directed to one Lester J. Stevenson to show cause why he should not be punished for contempt in declining to be sworn and testify, pursuant to a subpoena issued by a circuit court commissioner of Wayne county and duly served on him, in a certain cause then pending between relator, as plaintiff, and one Madeline Clements, defendant.
