This matter is before the court for ruling on Defendants’ motion to dismiss, filed February 2,1998.
I. Factual and Procedural Background
This is an action brought by Plaintiff under the Fair Debt Collection Practices Act (“FDCPA”), 15 U.S.C. § 1692, et. seq., and North Carolina law (N.C. Gen.Stat. § 58-70-90 et. seq., and N.C.
