This matter comes before the Court on defendants’ motions1 to dismiss pursuant to the Court’s discretion in declaratory judgment actions and pursuant to Rule 12(b)(7) of the Federal Rules of Civil Procedure and on Motion of Defendants For Rule 11 Sanctions Against Plaintiff (December 29, 1987).
