CHAMBERS, District Judge.
Pending before the Court is Defendant Monroe Scarbro’s February 1, 2001 supplemented motion to dismiss. For the reasons discussed below, Defendant’s motion is DENIED WITHOUT PREJUDICE.
I. Statement of the Case
