This action was brought to recover damages sustained by reason of the death of Charles H. Osthoff as the result of alleged negligence of the defendant. The acci dent, which resulted in Charles H. Osthoff’s death, occurred in the defendant's Mitchell yards at Milwaukee on August 2, 1934, while Osthoff was engaged in interstate commerce in the performance of duties in the course of his employment by the defendant.
