— Clay Puett instituted this action in equity for the purpose of setting aside a default judgment entered against him by a justice of the peace for Seattle precinct, pursuant to which personal property belonging to the plaintiff was levied upon by the sheriff and exposed for sale. Defendant E. E. Bern-hard bid in the property for $89.93, the amount of the judgment, interest, and costs, and in this action plaintiff also attacks this sale and asks recovery of his property, alleging that, after the sale, he had tendered the amount paid for the property, and, the tender having been refused, that…
