In an action for a divorce and ancillary relief, the defendant husband appeals from an order of the Supreme Court, Dutchess County (Jiudice, J.), dated April 9, 1993, which granted the plaintiff wife’s motion for partial summary judgment and struck that branch of the *654husband’s counterclaim which was for equitable distribution of the parties’ dental practice.

Ordered that the order is affirmed, with costs.
