Petitioner James Washington was convicted by a jury of capital murder in 1983 for the killing of Leroy Reason and is currently serving a life sentence. Following his trial in the Circuit Court of St. Louis County, Washington appealed to the Missouri Court of Appeals which affirmed his conviction. State v. Washington, 707 S.W.2d 463 (Mo.Ct.App.1986). Washington then filed a motion for post conviction relief which, after an eviden-tiary hearing, was denied by the state Circuit Court and affirmed by the Missouri Court of Appeals. Washington v.
