YOHN, District Judge.

The O.N. Equity Sales Company (“ON-ESCO”) brings this action against defendant Lawrence Emmertz seeking a declaration that it has no obligation to arbitrate any claims brought by Emmertz under the National Association of Securities Dealers, Inc. (“NASD”) Code of Arbitration Procedure (“NASD Arbitration Code”) and to enjoin the pending arbitration. The parties have filed multiple motions regarding the issue of arbitrability and whether discovery on this issue is necessary.
