R.C. Chapter 711 details the process through which a proposed subdivision is platted, approved, and developed; For purposes of this case, we are concerned primarily with provisions of that chapter which relate to the way a proposed roadway in a plat eventually becomes a public street. Two principal issues must be addressed: (1) Has Moreland Hills acquired a fee interest in the disputed parcel of land? and (2) If so, what are the consequences of that determination upon the enforceability of the restrictive covenant?
