HAGGERTY, Chief Judge.
Before the court are the parties’ cross-motions for summary judgment (Docs.# 49, 66, 70, 76) and plaintiffs Motion to Amend the Complaint (Doc. # 97). For the following reasons, the cross-motions for summary judgment are granted in part and denied in part. Plaintiffs Motion to Amend is denied.
