LIVINGSTON, Justice.
Katherine Richards, as administratrix of the estate of Walter Grady Richards, deceased, filed suit in the Circuit Court of Walker County against Clark and Creel, a partnership composed of Hoyt Clark and Elvin W. Creel; Clark and Creel, individually; the DeBardeleben Coal Corporation, and the Bituminous Casualty Corporation.
