Plaintiff Marcus McDaniel, an African-American man formerly employed by the U.S. Department of Agriculture (“USDA”) from August 2008 to July 2009 as a Safety & Occupational Health Manager, filed a one-count complaint against the Secretary of Agriculture, alleging that McDaniel’s supervisors discriminated against him because of his race and sex in violation of Title VII of the Civil Rights Act of 1964, 42 U.S.C. § 2000e et seq., by harassing him and terminating his employment.
