MARRERO, District Judge.
Yonkers Contracting Company, Inc., Tully Construction Co. Inc. and A.J. Pegno Construction Corp., d/b/a Yonkers/Tully/Pegno— a Joint Venture (collectively, “the Joint Venture”) have moved to intervene in this action as a defendant pursuant to Fed.R.Civ.P. 24, and to file a third-party complaint against a new proposed third-party defendant, Daidone, Inc.
