COLLYER, District Judge.
This lawsuit, brought under the Endangered Species Act, 16 U.S.C. § 1531 et seq. (“ESA”), and the unreasonable delay provisions of the Administrative Procedure Act, 5 U.S.C. §§ 555(b), 706(1) (“APA”), puts the Secretary of the Interior, Gale Norton, between the proverbial rock and a hard place.
