This case is before this Court upon appeal of a final order of the Circuit Court of Brooke County entered on August 7, 2001. In that order, the circuit court denied a motion for a new trial filed by the appellant and plaintiff below, Sandra Hicks, Adminis-tratrix of the Estate of Charles R. Hicks, deceased (hereinafter “appellant”), in this wrongful death action filed against the appel-lees and defendants below, Charles Gha-phery, M.D., and Wheeling Hospital.1 In the same order, the circuit court also denied the appellant’s motion for reconsideration of the order granting…
