Appeal from an order of the Supreme Court (Torraca, J.), entered April 21, 1994 in Ulster County, which denied defendants’ motion for, inter alia, an order of preclusion.

On October 18, 1988, plaintiffs’ home suffered extensive damage as the result of a fire originating in the vicinity of their kitchen refrigerator. Plaintiffs commenced this action against defendant Montgomery Ward & Company, from whom plaintiffs had purchased the refrigerator, and defendant Maytag Corporation, which was apparently the manufacturer of the refrigerator.
