This action in assumpsit was tried by a justice of the superior court sitting with a jury and resulted in a verdict for the plaintiff in the sum of one dollar. The case is in this court on the defendant's bill of exceptions. The only exception relied upon before us by the defendant is to the decision of the trial justice granting the plaintiff’s motion for a new trial, all other exceptions having been expressly waived. .
