This is an action of trespass on the case to recover for damage to plaintiff’s building caused by defendants, the general contractors in charge of the construction of the Loew’s State Theatre on land adjoining that of the plaintiff. The case is in this court on plaintiff’s exception to the decision of the trial justice granting defendants’ motion for a new trial after a verdict for plaintiff for $5,579.70.
