PROCEEDING for a Writ of Review originally taken in the Supreme Court to annul an order of the Railroad Commission of the State of California fixing certain water rates. Order annulled. The facts are stated in the opinion of the court.

Upon further consideration of this case we adhere to the opinion prepared by Mr. Justice Henshaw and rendered by the court upon the original submission. Some additional treatment of points discussed upon the rehearing is appropriate.
The principal reason for the order granting a rehearing was the desire of the court to re-examine the evidence upon the question of fact whether the Lake Hemet Water Company, at the time it executed to the respective petitioners the water contracts held by them, had dedicated to public use the water which the company thereby agreed to sell and deliver to the…
